Wills and Probate - An Overview

Wills and probate records created between 1841 and 1925 have been digitised and can be viewed online free of charge from the Wills and Probate Index.

Wills and probate records created between 1926 and 2013 can be ordered for viewing in our reading room at the Victorian Archives Centre (VAC) or by requesting a Remote Digital Copy Order or a Remote Photocopy Order. Fees and charges apply. Please note records are available for viewing within our reading room for 10 working days from the date ordered.

Public Record Office Victoria does not hold copies of unprocessed Wills. We currently hold Wills and Probate files that have been administered by the Victorian Probate office from 1841 to 2013.

Wills and Probate Process

Step 1: Use the Wills and Probate Index to search for and view online Wills and Probate records between 1841 and 1925.

Step 2: Use the Wills and Probate Index to search for and order to view the original Wills and Probate records between '1926 and September' 2009. For records covering approximately October 2009 to the end of 2013, use the Search Within a Series option in PROV’s catalogue, entering “17379” in the VPRS field, and the surname of the deceased in the “With any of the words or numbers” field. For records covering the 2009 – 2010 period, you may need to attempt both approaches described in this section.

Step 3: You must be registered as a public user with a user ID and a password to be able to order Wills and Probate records between 1926 and 2013. To set up a public user account, please follow our HOW TOguide 19 on How to register as a public user.

Step 4: For Wills and Probate records between 1926 and 2013, you are required to order these records. Follow our specific HOW TOguide 29 on Ordering Will and Probate Records

Step 5: Once you have ordered the record(s), you have three options. The first is to come into PROV and view the record. The second is to request a Remote Digital Copy Order and the third is to request a Remote Photocopy Order. Please note Fees and charges apply for remote digital and photocopy orders.

Step 6: Make payment online once we send you the link to pay via our secure online banking.

Step 7: Orders will take up to 25 days to be processed and either posted or emailed to you. If you wish to seek the status of your enquiry, click on the link available from your online enquiry form.
