Description:
Depositions, such as those contained in these documents, served as a record of the initial hearing held before a local magistrate in which the charges against a person arrested were presented. The evidence of a witness was heard in front of the accused who had an opportunity to respond. As a signed statement, depositions had legal weight and formed the basis of evidence for the full trial.

The documents in this item were for use in the State Treason Trials, and include recognizances to give evidence, as well as the depositions, dated 9 December 1854, of several witnesses to the storming of the Eureka Stockade.

Colony of Victoria Ballarat

To Wit

The examination of Edward Viret, Thomas Bradley, James Lough, George King, and, Henry Foster of Ballarat in the Colony, of Victoria taken on oath, this ninth day of December, in the year of Our Lord one thousand eight hundred and fifty four at Ballarat in the Colony aforesaid, before the undersigned one of Her Majesty’s Justices of the Peace for the _________ said colony, in the presence and hearing of William Molloy, Jacob Sorenson and Patrick Howard, who are charged this day before me for that they the said ________on the third day of *December 1854 at Ballarat in the said Colony did with diverse(?) other false traitors at present unknown fire upon, attack and kill certain troops of Our Sovereign Lady the Queen. This deponent Edward Viret on his oath saith as follows*

I saw prisoner Molloy towards the conclusion of the attack on Eureka Stockade being driven out. I collared him and took him he had no arms that I saw. By prisoner –you hade police behind you – you said it was only the beginning of the disturbance and you were sober.

I was inside the stockade with our men we drove prisoner Molloy out and a Sergeant of Police captured him – he said it was only the beginning of a row. It would not end there.

I saw prisoner toward (?) by a tent where a lot of men were standing. He was going a little to the right. I fired at the mob but not at him.

I saw prisoner Sorenson running among the holes just after the firing ceased he was dressed like he is now (?). I went to a tent and found prisoner with a revolving gun in his hand. He surrendered to me. He had the gun when I first him run away. He said I give myself up I am guilty.
