Description:
Depositions, such as those contained in these documents, served as a record of the initial hearing held before a local magistrate in which the charges against a person arrested were presented. The evidence of a witness was heard in front of the accused who had an opportunity to respond. As a signed statement, depositions had legal weight and formed the basis of evidence for the full trial.

The documents in this item were for use in the State Treason Trials, and include recognizances to give evidence, as well as the depositions, dated 8 December 1854, of several witnesses to the storming of the Eureka Stockade.

To Wit The examination of George King, Samuel Flackwell Furnell, Michael Lawler, John White, Eugene Bellars, , James Richardson Gaunt, John Sullivan, Joseph Raynor, William Richardson, John King, John Dogherty, Joseph Penrose, John Pennluna, James Wearne, Peter Ellis, James Clarke, Henry Bedwell, John Pennluna and Joseph Penrose taken on oath, this eighth day of December, in the year of Our Lord one thousand eight hundred and fifty four at Ballarat in the Colony aforesaid, before the undersigned one of Her Majesty’s Justices of the Peace for the said colony, in the presence and hearing of Charles Bowen, Thomas Barry, Michael Tuohey, Henry Read and James Campbell who are charged this day before me for that he the said on the third day of *December 1854 at Ballarat aforesaid did feloniously, wilfully and of their malice aforesaid fire upon attack and kill certain troops of Our Sovereign Lady the Queen. I galloped up and apprehended that man the two prisoners Charles Brown and Thomas (Barry?), were standing outside the tent next to that towards which the man ran. Brown was dressed, something like he is now he had no arms. I searched the tent but found no arms. This tent was about twenty

05527-p0000-000002-0050-010-020.jpg And this deponent Samuel Flackwell Furnell on his oath saith, I was in command of the mounted Police at the Eureka Stockade on the morning of the rd instant. I saw Read about the end of the firing inside the stockade. I called to him to come out as he was (my?) prisoner. He refused to do so I fired at him twice he did not come and a trooper brought him out. I saw no arms when he was brought out. The firing was just ceasing then.

On Sunday morning the 3rd instant, I was at the attack at Eureka Stockade - we rode up and charged the flank at the stockade – as we rode past prisoner Read was standing by a tent in the stockade called a guard tent.- he had a long piece in his hand and I saw him come out of the tent and fire at us the fire was thick just then we wheeled about and as we past again prisoner Read was standing rather lower down I

I saw prisoner Read with a long piece in his hand, he had it at the “present”. I cannot swear he fired it, as I heard many shots were being fired at us. By prisoners Counsel I think he had a dark coat with a cape and a brown hat a wide avalle (?) on. By the Bench I cannot be mistaken in the man.

He made a signal and said he would show us. I saw a party of armed men we turned down the hill, he ran after us and shouted to the mob, we went on and some bullets were fired close after us. By prisoner - you were close enough to speak to us we asked the way to Melbourne.

I saw prisoner Campbell inside the stockade while the attack was going on . I saw him with a pistol or revolver. I saw him run between two tents. I saw him fire. He fired in the direction of the troops who were about ten yards from the stockade.

The prisoner Tuohey was turned out of the stockade by one of the foot police – he ran away. I followed him and arrested him. He had a double barrel gun and when I caught him he threw the gun from him. I saw him coming out of the stockade. He got away from the Foot Constable. I then galloped after him.

going past sped (?) up and saw the Soldiers – I called Read up to see – we went up and met some troopers they searched us for arms and we went to our tent. Another trooper afterwards arrested us both and we were bought to the camp.

This deponent Peter Ellis on his oath saith I was at my tent which is near Reads on the morning of the 3rd instant. I saw him taken a little way from the Catholic Chapel. I was not quite dressed and got up because I heard the firing. I think Read had on cord trousers and a blue shirt.

I saw prisoner about a mile from the stockade Mr. Langley gave him in charge to me. He had on I think, a blue shirt and a wide awake (?). This was after the firing was over and while we were coming home with prisoners.

The prisoners tent is about thirty yards from mine in a gully the other side of Bakery Hill. I recollect seeing prisoner and his mate in bed on Saturday night week about eight o’clock. I was awake next morning by the firing prisoner came to me and asked if I heard it. I got up prisoner went to his tent. In (?) at about ten minutes the soldiers and prisoner came down, the troopers came and arrested prisoner. I have drawn (?) prisoner a will (?) during the meetings.

I saw prisoner Read on Saturday night the 2nd we went to bed and in the morning heard the firing We got up and saw the soldiers. I swear he was not out of the tent during the night until he was taken. He is a mate of mine. Read had no connection with the insurgents movements. He worked regularly.
