Description:
Depositions, such as those contained in these documents, served as a record of the initial hearing held before a local magistrate in which the charges against a person arrested were presented. The evidence of a witness was heard in front of the accused who had an opportunity to respond. As a signed statement, depositions had legal weight and formed the basis of evidence for the full trial.

The documents in this item were for use in the State Treason Trials against Thomas Dignum, and include recognizances to give evidence, as well as the depositions, dated 8 December 1854, of several witnesses to the storming of the Eureka Stockade.

Colony of Victoria Ballarat

To Wit The examination of William Revell of Ballarat in the colony of Victoria taken on oath, this ninth day of December, in the year of Our Lord one thousand eight hundred and fifty four at Ballarat in the Colony aforesaid, before the undersigned one of Her Majesty’s Justices of the Peace for the _________ said colony, in the presence and hearing of Thomas Dignum who is charged this day before me for that he the said Thomas Dignum on the third day of December 1854 at Ballarat in the colony aforesaid did * with other false traitors unlawfully, maliciously and traitorously fire at, attack and kill certain troops of Our Sovereign Lady the Queen. This deponent William Revell on his oath saith as follows*

05527-p0000-000002-0040-010-003.jpg This deponent William Revell on his oath saith I am a trooper in the Mounted 40th. I was at the attack at Eureka on the morning of the 3rd instant. While the firing was going on I saw about six men run away from the stockade. Prisoner Thomas Dignum was one of them – he had a long iron bar sharpened at the end like a spear. Four of us went away after them. Prisoner Dignum made a thrust at me with his spear and struck my mate. I pulled up and struck him on the head

William Revell resworn saith I cannot be mistaken in the identity of prisoner Thomas Dignum for I cut him on the head –he has a cut on his head now.

The prisoner declines to make any statement and is committed for trial at the gaol delivery in Melbourne in January 1855
